Your Status:
By placing an order through our site, you warrant that:
You are legally capable of entering into binding contracts; and
You are at least 18 years of age; and you accept our Terms and Conditions as set out herein.
No other terms and conditions that appear on any document issued by the Customer whether or not the same shall be signed by or on behalf of the Company shall apply.
Acknowledgement of receipt of a Customer’s enquiry or order by the Company shall not constitute acceptance of that order for contractual purposes. The sending of formal written acceptance or a delivery note or invoice by the Company shall alone constitute acceptance of the Customer's order.

Payment:
Visa Credit, Visa Debit, Visa Electron, Switch, and MasterCard are accepted as methods of payment. All transactions are in pounds sterling.
All sales for non-account Customers must be paid in full prior to dispatch or collection.

Delivery:
Toolmonkey Limited offers free delivery to most UK postcodes (excluding products requiring pallets) on many of its products. These will be marked as free delivery. Items not marked as free delivery will be subject to delivery charges at checkout. Adding items to your basket that contain free and non-free delivery statuses may also be subject to delivery charges. Outside these codes, or where other delivery options are required, when you order goods from our website the cost of delivery will be calculated automatically. Our aim is to keep all products in stock at our warehouse for fast delivery.


Stock availability:
We endeavour to keep in stock, or available, all items that we advertise for sale, however there can be occasions where this is not the case, which could be a result of warehouse stock errors, items sold on another platform before a stock update or any other reason. In the event that a product is unavailable for whatever reason, we may contact you to ask you whether you would like us to supply a suitable alternative product, or cancel your order and issue a full refund. We will not supply you with an alternative product unless we receive instruction from you that you wish us to do so. If you opt not to purchase an alternative product, we will refund the full value of the product and any applicable carriage charges. 
The website showing an item as ‘In Stock’ is on the understanding that our system is showing one or more in stock. This however is not a guarantee and does not negate the term set out above. 

Risk and Title:
The Products will be at your risk from the time of delivery. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

Delivery
The Company will use its reasonable endeavours to comply with dispatch, collection and delivery dates but such dates are estimates only and are not guaranteed and shall not be of the essence of any contract between the Customer and the Company.
In the event of any failure to make delivery or delay in delivery the Customer shall have no claim whatsoever against the Company for any indirect or consequential loss or damage of any kind.
Toolmonkey reserves the right to use whichever courier they deem fit to suit the size and weight of the parcel unless chosen by the customer on checkout. 
It is the customer's responsibility to select the appropriate delivery options to suit their needs. 
Non-signed for delivery options may be left in a safe place if you are not home to accept the delivery. By agreeing to these terms and conditions you accept that if left in a safe place and the parcel is stolen no claim can be submitted. 
Signed for delivery can be chosen as an upgrade on checkout. This is necessary for faster delivery times, and accurate tracking and will not be left in a safe place without your consent. If you do choose for the item to be left in a safe please this is at your own risk. 
Claim for lost or undelivered item(s).
Royal Mail requires 10 working days to class the parcel as missing.
DPD, DHL and Parcelforce require 2-3 working days to start an investigation. We will be able to assist quickly due to their comprehensive tracking.

The carrier company require you to:
- Fill in a 'Denial of Receipt' letter which we can email or send in the post. Failure to return the 'Denial of Receipt' letter, within the specified time frame, may mean the claim lapses.

Returns & Refunds: Items not required
Toolmonkey aims to provide you with as much information as we can about each product so that you can make an informed purchasing decision. However, to give you additional confidence, we will allow you to return any item if it is not what you require within 30 days of receipt as long as it has not been used and is returned in its original undamaged packaging.

All you need to do is go to the returns section of the website and start a return or contact us on 01525 374287 option 2 and we will assist you. 
We cannot accept proof of posting as confirmation of delivery.
Upon receipt of the item(s) we will refund the full value of the item(s) subject to them being unused and in their original condition and packaging. Unless otherwise agreed, you will be responsible for the costs for returning the goods to us.
It is your responsibility when trying on workwear to keep the item in as new condition. Do not remove any tags and all items must be tried on in a clean environment. Items showing signs of soiling or wear are excluded from receiving a full refund and in some circumstances may be retuned back to you. 

Safety footwear must be tried on in a clean environment. Ideally, walk around on a clean floor for a while and make sure they fit your foot type and are comfortable. Once footwear has been worn outside or classed as soiled they cannot be returned unless faulty. Do not place return stickers on the packaging.

Clothing is not guaranteed to fit every customer. Clothing items are not regarded as faulty if they do not fit you unless they fall outside of manufacturing tolerances. Evidence may have to be provided in these circumstances to start a claim.

Returning items part of a promotion. If you have received money off or an order or a discount as part of a special offer promotion a partial refund will be offered if part of the order is returned. The discount received will be calculated as a percentage to deduct from the refund. If the whole order is returned that made up the promotion, a full refund will be given. 

Faulty, Incorrectly Supplied and Damaged Items:
If an item has been incorrectly supplied, received damaged or is faulty then all you need to do is contact us for resolution. 
You must alert us within 3 working days of delivery of any shortages, damage or incorrect items. 
Picture evidence may be required in some cases. 
The Company does not manufacture the Goods it sells. The Company will use all reasonable endeavours to assist the Customer to claim the benefit of any manufacturer’s warranty or indemnity. The Company cannot however accept liability for the suitability, fitness for purpose, operation or effectiveness of Goods it does not manufacture.
The Customer will comply with the Company’s reasonable directions concerning any Goods which are claimed to be defective or damaged. If the Customer returns any Goods to the Company without the Company’s prior written consent, the Company may return them to the Customer, or store them, at the Customer’s risk and cost. Should the customer wish to return goods this will be at their own cost, or £25.00 collection charge will be made.

Fair wear and tear:

You have 3 working days after delivery to inspect any clothing including boots and shoes for manufacturing faults and be in good condition. 
Please contact us within this time frame if any faults are found. We will then assist you in rectifying any issues found. 

The right to reject
When you buy an item of clothing that is faulty, you are entitled to a full refund so long as no more than 30 days have passed, starting on the first day after you became the owner of the item or after it was delivered.
You won't be entitled to this refund if you had a reasonable opportunity to examine the item when buying it and the fault was so obvious that you should have noticed it.
If the item has been working a few times any faults that may occur with be accessed on a case by case bases under fair wear and tear. Photo evidence may have to be provided. 

The sale price will also be taken into account along with all other factors when a claim is made. The more expensive the item the better made it should be and last longer. This does not include accidental damage or misuse. An example would be buying £15 running shoes and then raising a claim after running a 23 mile marathon. This would fall under Fair wear and tear and no refund or replacement would be offered.
Remember that no items last forever and all clothes need to be looked after to avoid unnecessary damage. However, if there are genuine problems with an item of clothing, we will help to get this rectified.
  
Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control 'Force Majeure' Event. A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following
Strikes, lock-outs or other industrial action
Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster
Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Impossibility of the use of public or private telecommunications networks.
The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

English Law
Every contract to which these Terms and Conditions shall apply shall be construed in accordance with and governed in all respects by the Laws of England and the Company and the Customer agree to submit to the jurisdiction of the English Courts.

Consumer Sales
Except to the extent permitted by law, nothing in these Terms and Conditions shall affect or restrict the statutory rights of any person dealing with the Company as a consumer.

Statutory Rights:
Your Statutory Rights are unaffected by anything appearing in these terms and conditions.



Generic Social Media Giveaway Terms & Conditions

Promoter: Toolmonkey Limited, operating the Instagram account @toolmonkey_workwear and Facebook page Toolmonkey.

Eligibility: Open only to residents of the United Kingdom, over 18 years of age. Employees of the Promoter are not eligible. No purchase necessary.

Entry: Entrants must follow the specific instructions for each competition as announced on the respective social media platform. Only one entry per person per competition unless otherwise stated.

Competition Period: Each competition will have its own start and end dates, which will be clearly stated in the competition announcement.

Prize: Specific details of the prize, including its nature and value, will be announced for each competition. Prizes are non-negotiable, non-transferable, and non-refundable. No cash alternative is available. In the event a prize is unavailable, a substitute of equal or higher value will be provided.
